Is bankruptcy the "last resort", or the "end of the world"? You may believe that you need to file a bankruptcy, but that may not always truly be the case. We do offer an initial free half-hour consultation, which can frequently occur by phone, at your convenience. There may be non-bankruptcy alternatives, such as negotiation or perhaps even countersuit for collection abuses by creditors, which abuses are frequent. For example, once the collection agency knows where you are, and that you have an attorney, they can no longer legally harass you for collection of a debt. They cannot threaten you with garnishment or call your relatives, friends or employers. Depending on the amount of debt, and the numbers of creditors, it may be possible to restructure, renegotiate or otherwise settle your debt, and to avoid a bankruptcy altogether.
Bankruptcy is not the end of the world for several reasons, including the fact that major corporations file bankruptcies almost as a matter of course, in order to readjust their obligations. If major corporations, such as steel companies, airlines, K-Mart, FAO Schwartz, can file to re-organize, why shouldn't ordinary folks be allowed to reorganize their debts as well?. In fact, many of our clients have been able, within eighteen to twenty-four months after their bankruptcy discharge, to get refinanced at very favorable rates. The bottom line is that what you have heard about bankruptcy from creditors about ruining your credit forever is generally not accurate. In fact, we have been able, in some limited situations, to actually get clients financing while they were in Chapter 13 cases.
